Kedumba Drawing Award 2026

1. Invitation to enter. The Trustees of the Kedumba Trust (Trust or Gallery) invite the entrant identified in the Entry Form (you and your) to submit up to two works in the 2026 Kedumba Drawing Award (2026 Award).  By doing so you accept, and enter into a binding legal agreement with the Gallery, on the terms of the Entry Form and these Terms and Conditions (together, this Agreement).  Entries close at 4.00pm (AEST) on 30 June 2026.

2. Kedumba Trust. The Trust is established under a Trust Deed dated 25 February 1998 (Trust Deed).  The objects of the Trust as stated in the Trust Deed principally are to “maintain, preserve and develop the Kedumba Collection, to “continue and enhance the Award as a drawing award of excellence” and to “maintain the Kedumba Gallery as a public art gallery”.

3. Kedumba Drawing Award. The Award is an acquisitive drawing award.  One judge appointed by the Gallery will select approximately 50-55 finalists from the entries submitted and will choose one drawing as the winner for permanent inclusion in the Gallery’s Collection.  The 2026 Award prize for the artist of the winning drawing is AUD$20,000.  The 2026 Award exhibition will open on 22 August 2026 and close on 27 September 2026 (unless either date changes).

4. A “drawing”. The Trust Deed does not define “drawing”.  In this Agreement, “drawing”, “work” and “works” are interchangeable;  tryptich and dyptich works presented in a single frame are deemed to be one work.  That the work submitted is a drawing is left in the first instance to the judgement of the artist.  The judge’s assessment will be undertaken by reference to the photograph of your work provided with your Entry Form (which sets out the technical requirements for the image).  However, if the judge does not consider that a work submitted is properly characterised as a drawing, then the work will not be accepted as an entry in the 2026 Award.

5. Acceptance of entries. Your submission of an Entry Form does not entitle you to have your work exhibited in the 2026 Award.  The Director of the Award will notify entrants of their selection as a finalist.  If you are selected as a finalist, then you must deliver your work to the Gallery in accordance with this Agreement.  You consent to exhibition of your work in the 2026 Award finalists’ exhibition at the Gallery or other venue as the Trustees may decide from time to time and to publication of your name at the Gallery’s website including any profile information that you provide to the Gallery.

6. Judging of the Award. You irrevocably acknowledge and agree that the judge’s decision is final.

7. Submission and sale. In the Entry Form you must specify whether or not your business is registered for GST and your sale price that, if applicable, must be GST-inclusive.  Unless your work is the winning entry you offer your work for sale at the price you specify in the Entry Form which cannot change.  If you are selected as a finalist your price may be displayed on your work in the 2026 Award finalists’ exhibition and will be published in the 2026 Award catalogue.  If your work is sold during the exhibition, then your GST-tax invoice or regular invoice (as applicable) will be issued by you to the Kedumba Trust.

8. Works available for sale period. If your work is selected as a finalist the work will not be available for sale until the winner of the 2026 Award is announced.  Each finalist’s work, other than the winning work, must be available for sale and (whether or not sold) must remain in the 2026 Award finalists’ exhibition until the exhibition closes.

9. Sale agency. If you are selected by the judge as a finalist (not being the winner), then you appoint the Gallery as your exclusive agent for the sale of your work at the price you have specified in the Entry Form.  The agency automatically expires on the closing date of the 2026 Award exhibition.

10. Commission and payment. If your work is sold you authorise the Gallery to collect payment.  The Gallery will charge commission of 25% of the sale price (unless your invoice is a tax invoice in which case the commission will be calculated on your sale price less GST).  You will be contacted to provide your bank account details.  Within 14 days of receiving payment the Gallery will remit the balance sale price to your nominated bank account.  You are responsible for the calculation and payment of any tax including income tax and as applicable GST as a result of the sale of your work.  You have the opportunity at any time to take independent, professional legal and tax advice in relation to this Agreement.  The Gallery is not responsible for providing you with any advice including legal or tax advice.

11. Original work. You warrant that your work is your personally created original work;  that it does not infringe the copyright, moral rights or any other rights of a third person;  and that your work is not a photograph, photocopy, print or other image that is produced or enhanced by computer or otherwise generated by any kind of digital media.  Your work must have been executed within the eighteenth month period prior to the date upon which the Gallery announces that the 2026 Award is open for entry.  If you are selected as a finalist and if upon delivery to the Gallery your work differs in any particular from the photograph of your work that you supplied with your Entry Form, then your selection as a finalist will be immediately deemed to have been withdrawn by you and your work will not be exhibited.  If in that event the 2026 Award catalogue has already been printed, then the Gallery reserves the right to overlay “Withdrawn” on the catalogue image of your work and to correspondingly correct the Gallery’s website and its other digital platforms or printed publications.)

12. Size restrictions. If you are a finalist, the maximum framed size of your entry cannot exceed 1.00m x 1.2m in dimension.  If over-sized when framed your work cannot be eligible for entry in the 2026 Award.

13. Framing and labelling the work. If you are a finalist your work is to be submitted professionally framed behind glass or perspex and fitted with “D” rings ready for hanging.  Works that do not comply cannot be exhibited.  Your work must be clearly labelled on the back with your name and the title of the work.

14. Delivery of finalist works. You are solely responsible for arranging delivery and collection of your work including protective packaging which so far as is possible will be re-used when packing the work for collection if not sold.  Following finalist notification you will need to deliver your work to the “Coorah” building, Blue Mountains Grammar School, Matcham Avenue, Wentworth Falls between the hours of 9.00 am and 2.00 pm (AEST) up to no later than 2.00pm on Friday, 14 August 2026 .  On arrival at “Coorah” your work will be inspected for compliance with this Agreement and damage if any;  if the work is damaged or non-compliant for any reason you will be notified.  If you use an agent, courier or freight service for either delivery or collection, you have sole responsibility for arranging and paying your service provider;  if you have not completed their details in your Entry Form, then the Gallery must receive your written direction in advance authorising the Gallery to hand your work to your nominated service provider.

15. Insurance. You are responsible for any loss or damage to your work during transport including delivery and collection.  The Gallery recommends that you effect goods-in-transit or all risks insurance.  If you engage a freight company or agent it would be prudent for you to consider the contract terms relating to allocation of liability for any loss or damage to your work that occurs during transit including delivery and collection.  The Gallery will be responsible for loss of or damage to your work if any during the period that it is held at the Gallery.

16. Display. The Director of the Gallery has absolute curatorial decision-making authority as to the placement of each finalist’s work in the Gallery (or other venue as applicable) during the 2026 Award exhibition period.

17. Collection of work. On closure of the 2026 Award exhibition you must collect your unsold work from the Kedumba Gallery between the hours of 9.00am and 2.00pm (AEST) from Wednesday, 30 September 2026 up to and no later than 2.00 pm on Friday, 2 October 2026.  If your work is not collected accordingly, then your work will be stored by the Gallery at your expense.  After a reasonable grace period for collection, you will be given written notice (sent to your address in your Entry Form) of the Gallery’s intention to sell or otherwise dispose of the work as follows.  The Gallery will make reasonable endeavours to sell your work including by advertising the work at its website or otherwise.  If the work is sold, the Gallery will deduct its commission in accordance with this Agreement in addition to costs that are incidental to the sale and will hold the balance fund for you.  If the work remains unsold after a reasonable period, then the Gallery will dispose of the work as it sees fit.  In any event the Trustees exclude liability to you for any loss or damage as a result of exercising any of their reserved rights under this Agreement.

18. Entry Form representations. You warrant that all the information provided by you in your Entry Form is, and will remain, true and correct unless you notify the Gallery otherwise in writing.

19. Copyright. As a condition of your entry in the 2026 Award you grant the Trustees a non-exclusive, world-wide, royalty-free, irrevocable, perpetual licence (including the right to sub-license) to reproduce, publish and communicate your work for the proper purposes of administering the 2026 Award and marketing and promoting the 2026 Award prize and exhibition.  In addition if you are a finalist in the 2026 Award you grant the Trustees a non-exclusive, world-wide, royalty-free, irrevocable, perpetual licence (including the right to sub-licence) to reproduce, publish and communicate your work in the 2026 Award catalogue (together with profile information if any provided by you) and in any other digital and printed media for the Kedumba Gallery’s general marketing, promotion, archiving, reporting, education  and research activities from time to time in any media in any jurisdiction.

20. Moral rights. When the Gallery reproduces your work, the Gallery will do so in accordance with this Agreement, will attribute your work to you and will not make any changes to the work without your written consent.

21. Indigenous Cultural and Intellectual Property (ICIP) Rights. These are rights that Indigenous people have in their traditional arts, culture and cultural heritage to protect traditional knowledge and sacred cultural material and to ensure that traditional laws and customary obligations are respected;  the community associated with those rights is named or given attribution;  insulting, offensive or misleading use of traditional arts and culture is prevented;  and the recording of cultural customs and expressions which are essential to cultural identity, knowledge skill and teaching about Indigenous culture is controlled.  If your work incorporates, is sourced from, or refers to, ICIP material, then you warrant that you have obtained the informed consent of the community custodians of the ICIP rights to use the work, and for the Gallery to display and reproduce the work, as provided in this Agreement.  When submitting your entry, you must notify the Gallery of any ICIP requirements that may impact attribution, display or reproduction of the work.  You must provide evidence of ICIP consent to the Gallery upon request.

22. Governing law. This Agreement is governed by the law of New South Wales.
